Agreement to Terms
These Terms of Service are a legally binding agreement between you (the “Customer”) and Bairwal Tech Solutions (“Servyn”, “we”, “us”), governing your use of the Servyn POS, QR ordering, digital menu and related services (the “Service”). By checking the consent box at signup and accessing or using the Service, you give your explicit consent to be bound by these Terms and our Privacy Policy. We record the date and time this consent was given against your account. If you disagree with any part of these Terms, you may not access the Service.
Who These Terms Cover
The Service has two kinds of user, and these Terms apply differently to each:
- Restaurants subscribe to Servyn to run their business. The subscription, billing, cancellation and software-licence terms below apply to you.
- Diners use QR menus and ordering to place orders with a restaurant. Servyn provides the technology; the restaurant is the seller of the food and is solely responsible for the food, its description, pricing, preparation, hygiene, taxes and fulfilment. Any complaint about an order should be raised with the restaurant first; our Grievance Officer below remains available to you.
Account Approval
Signing up does not by itself activate the Service. New restaurant accounts are reviewed by us before activation, and the point-of-sale features remain locked until we approve the account and record a subscription term against it. We may decline to activate an account at our discretion. During this period your menu and settings are saved and nothing is deleted, and your free trial has not yet started.
Free Trial
- New restaurants get their first 3 months free, unless we agree a different trial length with you in writing. The trial starts when we activate your account, not when you sign up, so time spent waiting for approval does not come out of it. The exact end date of your trial is shown in your dashboard.
- No card and no payment details are required to start the trial, and nothing is charged when it ends.
- The trial gives you the full Service. We may set fair-use limits where a trial account is being used in a way that is clearly not a genuine evaluation.
- We will remind you before the trial ends. If you do not take a paid subscription, dashboard and point-of-sale access stops at the end of the trial in the same way as any other expiry — see “Expiry, Suspension and Loss of Access” below. Your data is retained and exportable as set out in “Your Data”.
- One trial per restaurant. We may decline a trial to a business that has already had one.
Subscription, Fees and Taxes
- The Service is licensed on a subscription basis for the term and plan recorded against your account. Prices are as quoted to you in writing at the time of purchase.
- All fees are stated in Indian Rupees and are exclusive of GST and any other applicable taxes, levies or payment-gateway charges, which will be added at the prevailing rate. A tax invoice will be issued for each payment.
- Subscriptions do not renew automatically unless you have expressly opted into auto-renewal. Where auto-renewal is enabled, we will notify you before each renewal charge and you may turn it off at any time before that date.
- Fees for a term already begun are non-refundable except as set out in our Refund & Cancellation Policy.
- We may revise pricing for future terms with at least 30 days’ written notice. A price change never applies to a term you have already paid for.
Cancellation and Refunds
You may cancel at any time. How cancellations and refunds are handled, including the cooling-off period for a first subscription, is set out in full in our Refund & Cancellation Policy, which forms part of these Terms.
Expiry, Suspension and Loss of Access
Please read this section carefully — it describes when the Service stops working.
- On expiry or non-payment. When your subscription term ends, is cancelled, or fees remain unpaid after their due date, your access to the restaurant dashboard, point-of-sale and desktop application will stop until the account is brought current. We aim to notify you before this happens, and the Service displays a countdown as the term approaches its end.
- Diner ordering is not affected by expiry. Your QR menu and diner ordering continue to work so that customers already in your restaurant are not left stranded.
- Periodic online verification. The desktop application continues to work without an internet connection for up to 14 days. After that it must reach our servers once to confirm your subscription before it will continue. This is an intended part of the product and is described in the End User Licence Agreement shown when you install it.
- Suspension for cause. We may suspend or terminate access immediately where we reasonably believe the Service is being used unlawfully, to harm others, or in breach of these Terms.
- Your data is not deleted. Loss of access is not loss of data — see “Your Data” below.
Your Data
You own the business data you put into the Service — your menu, orders, customers, staff records and reports. We process it to provide the Service and as described in our Privacy Policy.
For 90 days after your subscription ends or is terminated, you may request an export of your data in a machine-readable format and we will provide it at no charge. After that period we may delete it, except where we are required to retain records by law. If we terminate your account for cause, we will still honour an export request made within that window.
Desktop Software
Servyn Desktop is licensed, not sold, under a separate End User Licence Agreement presented during installation. That agreement governs your use of the software itself; these Terms govern the Service it connects to. Where the two conflict on a matter specific to the desktop software, the End User Licence Agreement prevails.
Use of Service
You agree to use the Service only for lawful purposes. You agree not to:
- Use the Service in any way that violates applicable laws, including food-safety, tax, labelling and consumer-protection law
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its servers
- Use the Service to transmit harmful code or malware
- Resell, sublicense or provide the Service to a third party without our written agreement
- Misrepresent prices, taxes, ingredients or allergens to diners through the Service
Availability
We work to keep the Service available but do not guarantee uninterrupted operation. The Service may be unavailable during maintenance, or because of failures in networks, hosting providers, payment gateways or other third parties outside our control. Unless we have separately agreed a written service-level commitment with you, the Service is provided on an “as available” basis.
Payments to Restaurants
Where diners pay through the Service, payments are processed by a third-party payment aggregator licensed by the Reserve Bank of India. Servyn does not store card numbers or banking credentials. Settlement of those funds to the restaurant is governed by the aggregator’s own terms and timelines, and we are not liable for delays or failures attributable to the aggregator, your bank, or incorrect account details you have provided.
Intellectual Property
The Service and its original content, features, and functionality are owned by Bairwal Tech Solutions and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You receive only the rights expressly granted in these Terms. Your own content — your menu, images, branding and business data — remains yours, and you grant us only the licence needed to host, display and process it in order to run the Service for you.
Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the total subscription fees you paid to us in the twelve months immediately preceding the event giving rise to the claim. We shall not be liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or any indirect, incidental, special, consequential or punitive damages.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any right you have as a consumer under the Consumer Protection Act, 2019 that cannot be waived by agreement.
Indemnity
You agree to indemnify us against claims brought by third parties, including your customers, arising from your use of the Service in breach of these Terms or applicable law — for example, claims about the food you sell, the prices or allergen information you publish, or your handling of your customers’ personal data.
Changes to These Terms
We may update these Terms. Where a change materially affects your rights or obligations, we will give you at least 30 days’ notice by email or in the dashboard before it takes effect. Continuing to use the Service after that date constitutes acceptance. If you do not accept a material change, you may cancel and receive a pro-rata refund of the unused portion of your current term.
Governing Law & Dispute Resolution
These Terms are governed by the laws of India. We ask that you contact our Grievance Officer first so we can try to resolve the matter directly. Subject to applicable consumer-protection law, which may entitle a consumer to complain to the District, State or National Consumer Disputes Redressal Commission having jurisdiction where they reside, the courts at Sirsa, Haryana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

We will acknowledge your complaint within 24 hours, issue you a ticket number, and dispose of it within 15 days of receipt.
